Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the Centaura Crew Platform (the "Platform"), including all associated features, services, and content. By accessing, registering for, or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

1. Use License and Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform subject to these Terms. You agree to use the Platform only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Platform.

Prohibited conduct includes:

  • Using the Platform in any way that violates applicable laws or regulations.
  • Attempting to gain unauthorized access to the Platform or its systems.
  • Interfering with or disrupting the normal operation of the Platform or its infrastructure.
  • Transmitting harmful, offensive, defamatory, or illegal content.
  • Impersonating another person or entity.
  • Harvesting, scraping, or automated collection of data from the Platform without authorization.
  • Attempting to circumvent security measures or access restricted areas.
  • Using the Platform for commercial purposes not authorized by us in writing.

2. User Accounts and Responsibilities

To access certain features of the Platform, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and password, and you are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You represent and warrant that you are at least 18 years old (or have obtained parental/guardian consent if under 18) and have the legal capacity to enter into these Terms. We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited conduct.

2.1 Age Requirements and Event-Specific Restrictions

While the Platform permits users aged 18 and above (or minors with parental/guardian consent) to create accounts, participation in specific events may be subject to additional age restrictions imposed by contracting authorities, event organizers, insurance requirements, or applicable laws.

If a contracting authority or event organizer sets a minimum age requirement (for example, 18 years or older), applications from volunteers who do not meet that age requirement will be automatically refused or rejected. We are not responsible for denying access to events based on age restrictions set by third parties, and such denials do not constitute discrimination or breach of these Terms.

Age requirements will be clearly communicated in event descriptions where applicable. It is your responsibility to review event-specific requirements before applying.

3. User Roles and Permissions

The Platform supports multiple user roles: User (Volunteer), Manager, and Administrator. Each role has specific permissions and capabilities. Your access to features is determined by your assigned role. We reserve the right to change, modify, or revoke roles and permissions at our discretion.

  • Users (Volunteers): Can register for events, manage availability, view assignments, track rewards, and manage their profile.
  • Managers: Can manage events, approve/assign shifts, manage accommodations and transportation, approve rewards, and oversee users within their scope.
  • Administrators: Have full system access including user management, platform configuration, and system-wide operations.

4. Events, Scheduling, and Shift Assignments

Event participation through the Platform is voluntary unless otherwise specified by your employment contract, volunteer agreement, or event terms. By registering for an event, you represent that you are able and willing to participate as scheduled.

Managers may assign, modify, or cancel shifts and accommodations as needed. You will receive notifications of any changes. Failure to fulfill committed shifts without proper notice or justification may result in sanctions as outlined in your volunteer agreement or contract. Reward points may be adjusted based on your performance and compliance with Platform requirements.

5. Contracts and Agreements

Some users may be required to execute formal contracts or volunteer agreements. Contracts generated through the Platform are binding legal documents. By accepting a contract through the Platform, you acknowledge that you have reviewed its terms and agree to be bound by them. Contracts are supplementary to these Terms & Conditions and take precedence in case of conflict regarding specific engagement terms.

6. Content and Intellectual Property

The Platform, including all text, graphics, logos, images, software, and other materials (collectively, "Content"), is the exclusive property of Centaura or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and print Content solely for your personal use in connection with the Platform. No part of the Platform may be reproduced, modified, transmitted, or used for any public or commercial purpose without our prior written permission.

You retain ownership of any content you submit to the Platform (including event information, availability data, messages, or documents you upload). By submitting content, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and display that content as necessary to operate and improve the Platform.

7. Liability and Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR OTHER DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR IF YOU PAID NOTHING, SHALL NOT EXCEED FIFTY EUROS (€50).

8. Third-Party Services and Links

The Platform may link to or integrate with third-party services, websites, and applications. We are not responsible for the content, accuracy, security, or practices of third-party services. Your use of third-party services is governed by their terms of service and privacy policies, which you should review. We are not liable for any damages or losses resulting from your interaction with third-party services.

9. Data and Security

While we implement reasonable security measures, no system is completely secure. You acknowledge the inherent risks of transmitting information over the internet. We are not responsible for unauthorized access, data breaches, or loss of data caused by factors beyond our reasonable control.

You are responsible for protecting your account credentials and the confidentiality of your information. If you suspect a security breach or unauthorized access, notify us immediately at eventsupport@centaura.be.

10. Acceptable Use and Conduct

You agree to use the Platform in accordance with all applicable laws and these Terms. You will not:

  • Engage in harassment, bullying, or discriminatory conduct.
  • Share misinformation or false information about events, assignments, or other users.
  • Disclose or share the personal information of other users without their consent.
  • Use the Platform for any unlawful, fraudulent, or deceptive purpose.
  • Violate the intellectual property rights of others.
  • Interfere with the Platform's operation or security.

Violations of acceptable use policies may result in warnings, temporary suspension, or permanent termination of your account at our sole discretion.

11. Modification and Termination of the Platform

We reserve the right to modify, suspend, or discontinue the Platform or any features at any time with reasonable notice. We will make reasonable efforts to preserve your data and provide migration options when feasible. We are not liable for any loss of data, functionality, or access resulting from modifications or discontinuation of the Platform.

We may terminate your access to the Platform immediately and without notice if you violate these Terms, engage in prohibited conduct, or pose a security risk. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (such as intellectual property rights, liability limitations, and dispute resolution) will remain in effect.

12. Indemnification

You agree to indemnify, defend, and hold harmless Centaura, its admins, managers, volunteers and other employees from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms or applicable laws; (c) your violation of third-party rights; or (d) content you submit to the Platform.

13. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles. Any disputes arising out of or related to these Terms or the Platform shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts located in Belgium.

You waive any objection to venue in these courts and consent to personal jurisdiction therein. If you are accessing the Platform from outside Belgium, you are responsible for complying with local laws and regulations.

14. Limitation of Time to File Claims

Any claim or cause of action arising out of or related to the Platform or these Terms must be filed within one (1) year after the cause of action arises, or such claim or cause of action is barred.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, shall be severed. The remaining provisions shall remain in full force and effect.

16. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it. No waiver of these Terms shall be effective unless in writing and signed by an authorized representative of Centaura.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other policies posted on the Platform, constitute the entire agreement between you and Centaura regarding the use of the Platform and supersede all prior agreements and understandings. However, this does not limit or diminish any contract specifically executed between you and Centaura for event participation or volunteer engagement.

18. Changes to Terms & Conditions

We may update these Terms & Conditions at any time. When we make material changes, we will post an updated date at the top of this page and, where appropriate, notify users via email or through the Platform. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. It is your responsibility to review these Terms periodically for updates.

20. Additional Terms

If you are using the Platform on behalf of an organization or entity, you represent and warrant that you have authority to bind that entity to these Terms. Your organization is responsible for compliance with these Terms by all users accessing the Platform through your organization's account.
